So it seems they are trying to use the database rights. I don't know if they are really enforceable in USA, but especially a non-EU user has nothing to fear when uploading them here on archive.org, at most they'll send a DMCA.

The nice alternative you have is writing them pointing out the benefits of public domain and the recommendations of Europeana. http://pro.europeana.eu/public-domain-content
